States Where THCA Is Banned or Restricted (2026)
These are the states where THCA flower is not permitted or is confined to licensed cannabis retail. Use the checker above for the detail on any single state.
Not permitted
Alabama, Alaska, Arkansas, California, Colorado, Delaware, Georgia, Hawaii, Idaho, Iowa, Louisiana, Maryland, Michigan, Mississippi, Montana, New Jersey, New Mexico, New York, North Dakota, Ohio, Oregon, Rhode Island, South Dakota, Tennessee, Utah, Vermont, Virginia, Washington, Wyoming, and Washington DC.
Restricted (some formats only, or licensed retail only)
Connecticut, Illinois, Indiana, Kentucky, Minnesota, Massachusetts, and Oklahoma.
Contested or unclear
Arizona, Kansas, Missouri, Nebraska, Nevada, South Carolina, Texas, and West Virginia. In these states the statute and enforcement practice disagree, or litigation is unresolved.
Currently permitted
Florida, Maine, New Hampshire, North Carolina, Pennsylvania, and Wisconsin follow the federal delta-9-only standard. Note that New Hampshire adopts a stricter standard on January 1, 2027.

How to Read These Categories
- Legal — the state follows the federal delta-9-only 0.3% standard with no total-THC rule or flower ban.
- Restricted — some hemp formats are permitted, but THCA flower specifically is barred or confined to licensed cannabis retail.
- Contested / Unclear — the statute and enforcement disagree, or litigation is unresolved. Treat with caution.
- Not Permitted — a total-THC standard, a scheduling action, or an inhalable-product ban puts THCA flower outside lawful hemp.
Why So Many States Diverge from Federal Law
The 2018 Farm Bill sets a federal floor, not a ceiling. Multiple federal appellate courts have held that states may adopt stricter standards than the federal definition. The most common state approach is a total-THC formula — delta-9 THC + (0.877 × THCA) — which counts THCA’s potential conversion up front. You can run those numbers on our total-THC calculator.
The November 12, 2026 Federal Change
Public Law 119-37, Section 781 moves the federal definition to a total-THC standard with a per-container cap on finished products, effective November 12, 2026. Proposals to delay or amend it remain pending in Congress. See our full breakdown of the November 12 change.
