Is THCA Legal in Alaska? 2026 Guide

Alaska: Not Permitted

Is THCA Legal in Alaska?

Alaska’s agriculture program will not endorse THCA products. The controlling authority is 11 AAC 40.400 and the Division of Agriculture advisory of January 31, 2025, and the measurement standard Alaska applies is post-decarboxylation delta-9 (which counts THCA).

That standard decides everything. Where a state measures total THC, delta-9 plus 87.7% of the THCA content, high-THCA material fails on the same lab result that passes federally. Run any Certificate of Analysis through the total THC calculator to see both numbers.

What Happened in Alaska

A federal court upheld the state’s restrictions in May 2025 in Alaska Industrial Hemp Association v. DNR. Unlicensed distribution of an ounce or more is charged as a felony.

What This Means for Buyers in Alaska

Intoxicating hemp is routed exclusively through AMCO-licensed marijuana retailers.

Alaska THCA Questions

Why is THCA not permitted in Alaska?

Because Alaska measures post-decarboxylation delta-9 (which counts THCA) rather than delta-9 alone, under 11 AAC 40.400 and the Division of Agriculture advisory of January 31, 2025. High-THCA material fails that test by definition.

Is any hemp product still legal in Alaska?

Intoxicating hemp is routed exclusively through AMCO-licensed marijuana retailers.

Does federal legality override this?

No. Federal law is a floor, not a ceiling — appellate courts have repeatedly upheld stricter state standards.
